Court of Appeal in Novi Sad 2026-04-22
In judgment Gž2 211/26, the Appellate Court in Novi Sad dismisses the appeal and affirms judgment P2 1435/2024 of 9 February 2026. The panel consists of presiding judge Branka Perc and members Aleksandra Pekez Kalinić and Marko Prentović. Full translations of all four pages and the searchable original are available. The court cites Article 31 of the 1976 Act, then describes Article 30's conditions concerning the child's age, parental status, the six-month period and the other parent's prior consent. It answers the objection that the applicable paragraph, 1 or 4, is unclear by stating that the conditions were in any event met. Local comments allow direct comparison with the parental and protective files, the original Act, the 1979 assessments and the grounds of appeal. The reasons find no inconsistencies in the professional assessments and treat the validity of the second adoption in 1984 as outside the subject of this case. The appeal, however, also uses the second act to test the legal effects of the first full adoption. Two separate costs statements are distinguished: that first-instance costs were not challenged by specific grounds, and that no claim for reimbursement of appellate costs was submitted. Thirty-five days separate the appeal dated 18 March from the decision of 22 April. This does not establish when the Appellate Court received the appeal. The stamp of 30 April confirms receipt at the Basic Court, not service on the appellant.
