Commenced at 8 o'clock.

Present at the hearing on full adoption:

  1. Gamber Andja, officer of the Guardianship Authority,
  2. Molnar Lidija, recording clerk,
  3. Vasić Milorad, adopter,
  4. Vasić Gospava, adopter,
  5. Vera Radovanović, special guardian.

The official Gamber Andja states that all summoned persons are present at the hearing, that the same was scheduled at the request of Vasić Milorad and Vasić Gospava from Budisava, as adopters, for the purpose of the full adoption of the minor MILETIĆ MILIVOJ, and in accordance with the provision of Article 30 of the Adoption Act /"Official Gazette of SAP Vojvodina", No. 24/76/.

In the preceding procedure, the Guardianship Authority established that all legal conditions for full adoption had been met, and that this adoption is in accordance with the provisions of Articles 2 and 4 of the Adoption Act.

The mother of the minor Miletić Milivoj has for a longer period been at an unknown place of residence and, without justified reasons, has not been performing her parental duty, and for those reasons, and pursuant to Article 5 of the Adoption Act, in respect of the minor Miletić Milivoj, by Decision No. Up.03-506/79 of 20.06.79, a special guardian was appointed in the person of Vera Radovanović, social worker, who gives consent to this adoption.

It was established that there are no impediments under Articles 10 and 11, and a positive opinion under Article 15 of the Adoption Act was given.

Since the parties have been acquainted with the rights and duties of the adopters and the adoptee, the adopters agree that the adoptee shall inherit from their possible property and exercise all rights under Article 36 of the Adoption Act, and having been acquainted with the provision of Article 40 of the same Act, the adopters expressed the wish that the adoptee bear the family name of his adopters and be named VASIĆ MILAN.

The Self-Managing Community of Interest of Social Protection Novi Sad, as the authorized Guardianship Authority, pursuant to the entrustment of guardianship affairs to the Self-Managing Community of Interest of Social Protection Novi Sad /"Official Gazette of the Municipality of Novi Sad", No. 8/77/, and Article 9 paragraph 2 of the Law on Civil Registers /"Official Gazette of the SFRY", No. 8/65/, and Article 4 paragraph 3 of the Law on Civil Registers /"Official Gazette of the SRS", No. 46/74/, and Article 35 of the Adoption Act /"Official Gazette of SAPV", No. 24/76/, deciding upon the request of Vasić Milorad and Vasić Gospava from Budisava, in the matter of the subsequent entry of the adopters' particulars as parents in the register of births kept by the Municipality of Novi Sad, hereby issues:

R U L I N G

APPROVES the subsequent entry in the register of births of the fully adopted child, the minor MILETIĆ MILIVOJ, born on 28 June 1974 in Novi Sad, with the following parental particulars:

Particulars of the father:

VASIĆ MILORAD, citizen of the SFRY, born on 15 February 1941 in the place of Osječani, Municipality of Doboj, residing in Budisava, Petefi Šandora Street 52.

Vasić Milorad and Vasić Gospava from Budisava, Petefi Šandora Street No. 52, submitted a request to this Authority for the subsequent entry in the register of births of the FULLY ADOPTED minor Miletić Milivoj, born on 28 June 1974 in Novi Sad, and for the entry of their particulars as parental particulars.

In the said request, the applicants stated that they request this because on 21.06.1979 they fully adopted the minor Miletić Milivoj according to the minutes on full adoption under No. Up.03-507/79, and that, pursuant to Articles 34 and 35 of the Adoption Act, they wish for the previous particulars in the register of births to be deleted and theirs entered, so that the adoptee shall henceforth bear the family name of his adopters and be named VASIĆ MILAN.

Upon consideration of this request, it was established that the same is justified, and therefore, within the meaning of Article 9 of the Law on Civil Registers, it was decided as set out in the operative part.

77 days: recorded case registration to full adoption

The dossier records registration on 5 April 1979 and the full-adoption record is dated 21 June 1979, 77 days later. Article 30(1) counts six months from abandonment of the child; the case-registration date alone does not establish when abandonment began. The personal sheet dated 10 April records Cvita’s address, yet the first-instance judgment identifies no concrete start or six-month interval and does not reconcile that record with the assertion of unknown whereabouts.

Full adoption as void identity-record mechanism

“Full adoption” is the legal form used here to impose a Vasić civil record over the child’s original identity and parental line. It must be read with Articles 35, 37, 38, 39 and 41 of the SAPV Adoption Act and with Vera Radovanović’s conflict-of-interest chain.

Pages 1–3

Input identity: Milivoj Miletić

21.06.1979 / SIZ Novi Sad / The minutes repeatedly identify the child entering the proceeding as Miletić Milivoj. “Milan Vasić” is not an original fact; it is the administrative product created by this act.

Page 1

Original child identity in official order

The official-name-order form “MILETIĆ MILIVOJ” fixes the original civil identity inside the very record that then rewrites it. The document first preserves the original child, then converts him.

Page 1

Adopter inserted into father position

Vasić Milorad is not recorded here as a biological father. He is inserted into the father position by the same act that erases the child’s previous parental data, despite the paternal-line record tied to Pavle / Pál Lakatoš.

Pages 2–5

Adopter inserted into mother position

Vasić Gospava is inserted into the mother position in the register while the living mother Cvita Miletić is absent from the act and replaced procedurally through a special guardian.

Pages 2–5

Conflict-of-interest guardian

Vera Radovanović is not a neutral protector in this act. The same official had already handled the tracking file, built the narrative about the mother and paternal line, recommended the Vasić couple, then became the one-day special guardian who gave consent to the full adoption.

Page 1

Constructed maternal absence

The act builds the parental-vacuum premise through the mother: unknown residence and alleged failure of parental duty. That premise is then used to replace the living mother with Vera Radovanović’s consent and to execute full adoption.

One-day guardian bridge

The special guardian is installed on 20.06.1979 specifically for consent, one day before the full adoption. That timing turns guardianship into a procedural bridge to the already prepared adoption outcome.

Consent by conflicted guardian

The consent is given by Vera Radovanović after her earlier role in the same chain: tracking file, mother narrative, adopter recommendation, and then special guardian. This is the consent point of a closed institutional loop.

Article 34: parental data in the full-adoption record

Article 34 prohibits entering information about the adoptee’s parents in the record establishing full adoption. This record nevertheless describes the mother’s alleged unknown whereabouts and failure to perform parental duties as the basis for guardian consent. Article 33 only says that prior parental consent is not read aloud at the hearing; it does not remove the separate requirement in Article 30(4). This is the direct record-content conflict raised in the revision; Article 34 alone is not a listed ground of nullity under Article 41.

Void adoption record imposed over original identity

“VASIĆ MILAN” is not a neutral new identity. It is the administrative record imposed over Milivoj Miletić through the contested full-adoption route of 21.06.1979, built through Vera Radovanović’s prior narrative, recommendation, one-day guardianship role and consent.

Pages 1–5

Operative identity substitution

This is the operative sentence of the first identity cut: the same document that names the child as Miletić Milivoj declares that he will hereafter be Vasić Milan.

Page 2

Forced assimilation mechanism: Milivoj to Vasić

The operative sentence moves the child from the original Miletić identity into the Vasić adoptive record. Read with the 1974 Croatian maternal line and P-1642/76 Hungarian paternal line, this is the administrative mechanism of forced assimilation.

Operative decision section

Adopters entered as parents

The report is not merely archived; it is sent to the registrar so the adopters are entered as parents of the child. This is the register-level parental replacement.

Article 35 — register rewrite mechanism

Article 35 is the register mechanism used here: the adopters’ particulars are entered as parental particulars. In this document it functions as the legal instrument for replacing the child’s prior parental data.

Page 3

SAPV Adoption Act 1976 · Article 35

Previous register data deleted

The ruling records the mechanism of erasure: previous birth-register particulars are to be deleted and the adopters’ particulars entered. This is not a caption; it is the administrative deletion of the prior parental record.

Same-day finality

The register rewrite becomes final the same day. The child is five, the mother is absent, the paternal/probate line is not processed here, and the identity rewrite is closed immediately.
