Case No.: O. 2470/78
Date: 10 January 1979
Page marker on scan: 4/3

A record drawn up before the Municipal Court in Subotica on 10 January 1979, in the probate matter of the late Pavle Lakatoš.

Persons present on behalf of the court

Judge: Marko Krnajski
Court clerk: Erika Šipoš

Before opening the probate hearing, the judge warned the parties that they have the right to an interpreter for the Hungarian language and that they have the right to use their own language.

Upon the court’s summons, Verona Lakatoš, the divorced spouse of the deceased, appeared.

After the reading of death certificate no. 31 of 10 November 1978, the appearing party states that the other heirs are prevented from attending, and that Roža Koplanj did not receive the summons; it was returned with the notation that the address was insufficient.

The appearing party states that Roža Koplanj lives in Novi Sad, at Slana Bara, Zadružna 25.

The appearing party states that, during the lifetime of the deceased, litigation had been initiated concerning the division of the deceased’s property and the determination of her ownership share on the basis of marital/community property, and that the proceedings were discontinued after the death of the deceased; and that the real estate, that is, all property, constitutes joint marital/community property because it was acquired during the marriage, and she requests that one half be recognized as belonging to her in ownership, while the other half is the subject matter of the estate.

The court issues the following

DECISION

Today’s hearing is adjourned to 15 February 1979 at 10:00 a.m. The appearing party is notified of this by proclamation of this decision and is ordered to obtain accurate information regarding the property of the deceased. A written summons shall be sent to Roža Kopljan of Novi Sad, Slana Bara, Zadružna 25, and to Iren Lakatoš and Ištvan Lakatoš, at Novi Sad, Trg Majke Jevrosime no. 5, with the indication that Verona Lakatoš is asserting a claim regarding the joint marital/community property of the deceased.

The Self-Managing Community of Interest for Social Protection, Novi Sad, on the basis of Article 1 of the Decision entrusting guardianship authority tasks to the Self-Managing Community of Interest for Social Protection, Novi Sad (Official Gazette of the Municipality of Novi Sad, No. 8/77), and Article 202 of the Law on General Administrative Procedure (Official Gazette of the SFRY, Nos. 18/65 and 4/77), deciding upon the request of the Municipal Court in Novi Sad, File No. O.196/79, hereby issues the following

II

The statutory heirs are:

  1. Róža Kopljan, Novi Sad, Slana Bara, Zadruga No. 25, daughter
  2. Irena Beker, daughter, Novi Sad, Trg Majke Jevrosime No. 3

The statutory heirs accepted the inheritance as belongs to them by law, and on behalf of the minors, the statements were given by their representatives and guardian. With regard to the liabilities of the estate, the heirs acknowledged them, and on the basis of all that has been stated, it was decided as set out under point III of the decision.

The lump-sum inheritance tax will be determined subsequently.

Hungarian language right in paternal estate file

The probate court records the right to a Hungarian interpreter and the right to use one's own language. This language trace sits inside the paternal estate file of Pavle / Pal Lakatoš, while the child's later imposed identity track cuts him away from the father's language line.

Page 1

Open timeline event

Hungarian language right recorded

The estate file begins by recording the right to Hungarian interpretation and use of one's own language. That language trace belongs to the paternal Lakatoš file; the later imposed identity track cuts the child away from that father-language line.

Pál’s residence certificate

The certificate records Pál’s birth identifiers and Novi Sad residence registration on 2 June 1955. It corroborates the deceased’s identity and residence. It is not the paragraph introducing Milivoj or judicially establishing the child’s paternity.

Broader comment

The probate file is not a neutral property file. It is the estate line of Pavle / Pal Lakatoš, the paternal line into which Milivoj Miletić is later expressly introduced as acknowledged child and heir.

Helena ends Roža’s representation on 3 April

Helena notifies the court that she and Roža mutually terminated the power of attorney as of 3 April 1979. This follows the 19 March hearing where she introduced Milivoj. The withdrawal identifies the end of that representation, not the disappearance of the child’s earlier acknowledgment lead.

Original identity survives the void adoption record

O.196/79 keeps Milivoj Miletić visible inside Pavle / Pal Lakatoš’s estate after CSR Novi Sad had already produced the contested Vasić civil record through the 21.06.1979 adoption route. This is not a neutral second identity: it is original identity versus a void adoption record.

Helena attends for Roža

The 19 March attendance list places Helena with Roža in the probate hearing. Earlier P-1642/76 records her representation of Pál. Her following statement about his acknowledged child therefore has a documented preceding link to the father’s court file.

Helena introduces the acknowledged child

On 19 March 1979 Helena adds five-year-old Milivoj to the heirs and says the deceased acknowledged him, while judicial paternity was not established. She requests a guardian to protect his interests. This is the starting point of the child’s recorded probate protection, before the June adoption.

Broader comment

Milivoj Miletić is not absent from the paternal estate. This document places him inside O.196/79 as a child whose rights and inheritance position require protection.

Helena supplies the acknowledgment lead

Helena identifies Milivoj, the deceased’s acknowledgment and the child’s placement with the deceased’s parents, then seeks a guardian. Lisica’s later no-data statements in 1980 stand against this already recorded lead and her earlier representation in P-1642/76. The available later records contain no reported inquiry to her explaining the source of her knowledge.

Acknowledgment lead — Helena opens the heir trace

This phrase is the open door in the probate file: paternity is not judicially established, but Pavle / Pal Lakatoš acknowledged Milivoj. Helena places that lead before the court and asks for guardianship protection of the child's interests.

Court repeats acknowledged-son status

The court’s 20 July request calls Milivoj the deceased’s extramarital son, records acknowledgment and asks for a guardian despite the absence of judicial paternity. This comes after the 21 June Vasić act and still uses the original child’s name inside the paternal estate.

20 July 1979 order keeps original Milivoj in the paternal file

20.07.1979 / Municipal Court Novi Sad – Mara Prica / the court asks for a guardian for Milivoj Miletić, five-year-old extramarital son of the deceased acknowledged by Pavle / Pal Lakatoš. This order comes after CSR Novi Sad had already produced the contested Vasić civil record. The probate channel still holds the original Milivoj Miletić in the paternal-inheritance trace; the adoption channel is only a void administrative record imposed through Vera Radovanović’s chain.

Appointment reasoning cites the court’s request

The SIZ reasoning dates the court’s request to 30 July, while the preserved court letter is dated 20 July. This is a date discrepancy between the request and the appointment’s account of it. Both concern protecting the same Milivoj in Pál’s estate.

Lisica acquainted with the probate file

Milivoj Miletić is not absent from the paternal estate. This document places him inside O.196/79 as a child whose rights and inheritance position require protection.

Milivoj receives one quarter

The court gives Milivoj Miletić a one-quarter inheritance share. The later exclusion track therefore attacks an existing recorded inheritance position, not an empty or imaginary claim.
