Record of the main hearing — P2.470/24, 2 April 2024

Source

This is a complete English translation of the two-page hearing record from the supplied photographs. The public PDF is a redacted copy; every occurrence of the plaintiff’s lawyer’s name is marked [redacted]. The judge, lay judges and court clerk remain named in their official roles.

The record gives a starting time of 08:15, postponement because the procedural conditions for holding the hearing were not met, and a closing time of 08:30. The plaintiff did not attend in person, his authorized representative did, and no one attended for the defendant; the case file did not show service of the defendant’s summons. The next hearing was scheduled for 24 April 2024 at 11:00. That date does not establish that the next hearing took place.

It is established that the defendant has not appeared at the hearing and that service of the summons upon the defendant is not shown in the case file as at the date of the hearing.

Since the procedural conditions for holding the hearing are not met,

The panel makes the following

RULING

The hearing is postponed.

The next hearing is scheduled for:

24. 04. 2024 at 11:00 a.m.,

which the plaintiff’s authorized representative, who is present, acknowledges; therefore, no written summons will be sent to her. She also undertakes to inform her client of the date and time of the hearing, so no summons needs to be sent to her.

Editorial note

This note is not part of the hearing record. The statement that service upon the defendant is not shown does not signify deliberate refusal to attend. The preprinted small-claims notice is reproduced as form text, not as an additional classification of these proceedings. The record contains no decision on the merits of the claim; it records postponement, the new hearing date, and directions for notification and summons.

CSR: no appearance; service not shown

The attendance entry records no one for the defendant CSR and says service is not shown. Page 2 then uses the missing proof of service as the reason why the procedural conditions for holding the hearing are not met.

ZPP — Article 118 · Reading and correcting the hearing record

The form’s printed reference to “particulars under Article 118(1)” does not match the current Act’s numbering. Those particulars are in Article 116(1), to which the current small-claims provision, Article 474, expressly refers. The printed numbering corresponds to Articles 118(1) and 473 of the 2004 Act. This is evidence of an outdated reference in the form; it does not establish that the court applied the former Act or classified this identity/adoption dispute as a small claim.

Civil Procedure Act (ZPP) · Article 118

ZPP — instruction for completing the record

This is the hearing form’s printed instruction to continue the record on blank pages and add sheets if needed. It describes how the form is to be completed; it does not establish that pages were omitted or that the hearing had no substantive content. No article is specified here.

Civil Procedure Act (ZPP)

Missing proof of service in the case file

Page 2 repeats the point as the reason for the panel’s procedural decision: service upon the defendant is not shown in the file as at the hearing date. The panel led by Bojana Vujić then records that the conditions for holding the hearing are not met and postpones it.

24 April: counsel must notify her client

The panel sets 24 April 2024 at 11:00. Counsel acknowledges the date and undertakes to notify her client; the record says no written summons will be sent to her. It separately directs that the CSR be summoned in writing with the 1 April submissions. These are different notification arrangements for the two sides.
