Inheritance Track versus Adoption Track
The probate file preserves Milivoj Miletić in the Pavle / Pal Lakatoš heirship frame while the adoption track moves him into the Vasić construction.
This is the property-side contradiction. The child appears in the inheritance frame as Milivoj Miletić, while the adoption machinery creates and advances Milan Vasić. The estate record and the adoption record are not two harmless archives; they are conflicting legal realities.
Documentary continuation — acknowledgement, heirship and exclusion
The P-1642/76 divorce record contains Pavle / Pál Lakatoš’s own statement that he had a son with Cvita and the judgment’s finding that he had a child with Miletić Cvita. These passages are part of the divorce case’s evidence and factual findings.
In O.196/79, the record of 19 March 1979 and the court’s protective correspondence identify the minor Milivoj, refer to the deceased’s acknowledgement, place the child with the deceased’s parents and call for a guardian to protect his inheritance interests. The inheritance decision of 23 November 1979 assigns him one quarter of the estate. The later challenge and exclusion file preserves Pervaz’s appeal and the decision of 9 January 1980 setting that part aside and requiring proof of acknowledgement, including acknowledgement in a public document. That requirement must be compared with the already existing divorce record.
The full-adoption record of 21 June 1979 runs through the same period and produces Milan Vasić. Article 37 of the 1976 law provides for termination of blood-relative rights upon full adoption; the author contests the legality of the very adoption on which that consequence depends. This is the concrete collision between protection of the child as heir and use of the adoptive identity to remove him from that position.
Preserve the precise words of the probate source
Pervaz’s appeal states that the adopters “do not seek” the child’s inheritance from anyone. Page 15 of the 2026 revision instead uses “do not object”. The linked source comparison keeps this difference visible. Both passages are Pervaz’s reported account of the adopters’ position, rather than their own directly recorded declaration.
