Revision of 29 May 2026: the appellate judgment confronted with the 1976 law and the identity evidence

Milan Petrović, through advocate Nikolaj Petronijević, challenges judgment Gž2 211/26. The revision addresses the confusion of Articles 30 and 31, the formula that conditions were fulfilled “in any event”, Cvita’s missing consent, Vera Radovanović’s combined roles, Pavle’s acknowledgment and the second adoption despite Article 40.

The 22-page revision is dated 29 May 2026 and is addressed to the Supreme Court through the Basic Court in Novi Sad. It challenges the appellate judgment of 22 April 2026, delivered by panel president Branka Perc and members Aleksandra Pekez Kalinić and Marko Prentović. The power of attorney named on page 1 is dated 25 May. The PDF export date of 28 May is not the pleading date, and this copy does not independently prove court filing or a Supreme Court outcome. The revision demands specific answers about Article 30(1) versus (4), the six-month period and search, the absence of Cvita’s consent, and Article 42’s omission of Article 5 from the provisions applied to full adoption. It confronts the appellate reference to Article 31 with the actual text of Article 30; distinguishes Pavle’s personal acknowledgment in divorce proceedings from a separate paternity judgment; and asks how the 1984 adoption can be legally reconciled with an allegedly valid, indissoluble full adoption from 1979. The plaintiff’s argument about forced assimilation and continued institutional maintenance of a void identity act is preserved in full. Articles 34, 35, 37, 38 and 40 are connected to the specific statutory effects described. An editorial note identifies the revision’s “do not object” wording against the actual 1979 probate appeal’s “do not seek”; the original pleading remains unchanged. Six cited Strasbourg cases are linked and distinguished by their actual subject matter.
