BASIC COURT IN NOVI SAD
Case number: P2.1435/24
PLAINTIFF’S SUBMISSION
(Objection concerning service and request for evidence justifying the defendant’s absence)
Plaintiff: Milan Petrović, Kragujevac, street and house number [redacted]
Defendant: Centre for Social Work of the City of Novi Sad, Zmaj Ognjena Vuka 13, Novi Sad
I. Relevant facts
- The hearing for my examination was scheduled for 3 September 2025 at 10:00.
- That morning I saw no notice for this case on the court’s noticeboard; after enquiring at the court, I was informed that the hearing had been postponed because of “health reasons affecting the defendant’s representative”.
- The court’s order/notice is dated 28 August 2025, bears a Novi Sad postal postmark of 2 September 2025, and was delivered to me on 4 September 2025 (a photocopy of the envelope is attached).
- The defendant’s request of 27 August 2025 (no. 560-111-1/2024) refers to the representative’s illness, but is not accompanied by any medical documentation.
This sequence — postal postmark 2 September → delivery 4 September, after the hearing date of 3 September — objectively calls into question both the timeliness of service and the justification for the postponement.
II. Proposals and requests to the court
1. Evidence of the defendant’s representative’s inability to attend
That the court require the defendant, within seven days of receipt of this order, to provide a certificate from the competent doctor (healthcare institution, stamp, doctor’s name and signature, exact date and time of examination, and a clearly specified period of temporary inability to work/appear in court). To protect privacy, the diagnosis may be omitted; only evidence of actual inability to attend during the relevant period is required.
- If the document was created electronically, that the defendant also provide an extract from the system/record of the certificate’s issuance (log, number and date of issuance).
- That the court prohibit the defendant from destroying the original until the proceedings have concluded.
2. Consequences if there is no evidence
If the defendant fails to provide the requested certificate within the time limit, or provides incomplete/inadequate records, that the court refuse to accept the excuse and treat the absence as unjustified, with all procedural consequences under the Code of Civil Procedure (cost consequences, a warning concerning abuse of rights, unhindered taking of evidence with the attending party, and so forth).
3. Dispatch records (court registry)
That the court obtain and place in the case file the court registry’s official dispatch record (the date and time of outgoing dispatch of the notice/order dated 28 August 2025), so that the circumstances of timely service can be fully clarified.

4. Further course of the proceedings
That the court hold the next scheduled hearing (15 October 2025, 10:30) and examine the plaintiff as a party to the litigation, and that the hearing not be postponed for the same reason unless the defendant provides, in good time — no later than three days before the hearing — a proper medical certificate of inability to attend.
III. Attachments
- Photocopy of the envelope bearing the postal postmark “Novi Sad 02.09.2025” (received on 4 September 2025).

Subject: Request for postponement
A hearing concerning the action brought by Petrović Milan of Kragujevac for annulment of a full adoption is scheduled for 3 September 2025. Editorial distinction between the two texts
The CSR request gives illness of an unnamed representative and the other representatives’ commitments as its reasons. The one-page court order states the cancellation and the next date; it contains no separate statement of reasons. The request and attached court order contain no medical certificate. The receipt stamp records the CSR request’s receipt by the court, not the plaintiff’s receipt of the court order.

Delivery after the hearing date, recorded in the October submission
The plaintiff already states the 4 September delivery date in this dated written submission. The envelope independently shows a 2 September postal stamp. Its blank delivery-attempt form does not certify 4 September; that date is the author’s written account. The linked September account describes the same sequence, not another postponement.

The evidence requested concerns Katarina Stolić’s CSR request
The attached CSR request is signed by director Katarina Stolić, names an unnamed representative’s illness and other representatives’ commitments. The supplied annex contains no medical certificate. This supports asking what material Bojana Vujić had when deciding, without inventing the contents of an unseen court file.

A proposed seven-day obligation, not an existing court order
The plaintiff asks the court to impose this obligation, with specified certificate details and protection of the diagnosis. The seven-day period is tied to receipt of the order he seeks. The submission itself does not prove that the court made that order or that the proposed evidentiary format is a universal statutory requirement.

ZPP — requested consequences of unsupported absence
The claimant asks the court to reject an unsupported excuse and consider costs, abuse-of-rights warnings and proceeding with the attending party. The detailed certificate and deadline are proposed requirements in his submission. This general law reference supplies no particular article and is not a court order granting the requests.
Civil Procedure Act (ZPP)
Court dispatch, postal stamp and delivery are separate facts
This request targets the missing date and time of dispatch from the court registry. The 28 August date on the order and 2 September postal stamp do not by themselves establish when the registry handed the item over. The request seeks that specific record, beyond the already attached envelope.

The requested examination is documented on 15 October
The plaintiff asks for the scheduled examination to proceed and proposes a condition for any renewed illness-based postponement. The subsequent 15 October record confirms examination of him as a party. That later event does not establish that the court also granted every request in this submission.

Dated 2 October; expressly maintained on 27 October
The date is printed in the submission, rather than inferred from its filename. Section IIIA of the 27 October submission expressly maintains these requests concerning justification of absence and dispatch of the 28 August order. Neither this date nor the later reference substitutes for proof of filing or a court ruling on them.

ZPP — cancellation-mailing form
S4 is the court’s postal notice form attached to the cancellation evidence. Its 2 September 2025 postal stamp is separate from the author’s reported receipt on 4 September, after the scheduled hearing. The form’s label identifies civil-procedure correspondence without citing an article.
